1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of the VividFest website and related services (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Accounts & Authentication

To access certain features (for example purchasing tickets, commenting, or accessing member-only pages) you may be required to create an Account.

2.1 How to create an account

You can create an Account in two ways:

  • Google OAuth: Sign up / sign in using your Google account. When you choose this option we receive basic profile information from Google (e.g., name, email address, and profile ID) as permitted by Google and consistent with their privacy policy.
  • Email + Password: Register with your email, first and last name, and a password. You are responsible for keeping your password secure and for any activity on your account.

2.2 Account security

You agree to keep your account credentials confidential and to notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized use of your account unless such loss is due to our gross negligence.

2.3 Account information & data

By creating an account you consent to the collection and use of the personal data described in our Privacy Policy. If you use Google OAuth you also consent to any data sharing between Google and VividFest necessary to authenticate you.

3. User Conduct

When using the Service you must not:

  • Use the Service for unlawful purposes or in a way that violates applicable laws
  • Upload or distribute malware, spam, or other harmful content
  • Impersonate another person or provide false information
  • Attempt to gain unauthorized access to parts of the Service

4. Tickets, Events & Purchases

Information about events, schedules and ticket availability is provided in good faith but may change. VividFest is not responsible for cancellations or modifications due to force majeure or other circumstances beyond its control.

All purchases are subject to the specific Terms of Sale at the checkout. Refund and exchange policies (if any) are stated at the time of purchase.

5. Intellectual Property

All content on the Service — including text, images, logos, designs and code — is owned or licensed by VividFest. You may not copy, reproduce, republish, upload, post, transmit or distribute any material from the Service without our prior written consent.

6. Limitation of Liability

To the fullest extent permitted by law, VividFest and its affiliates will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability for direct damages is limited to the amount you have paid to VividFest in the 12 months prior to the claim, or €100, whichever is higher.

7. Privacy & Cookies

Our collection and use of personal data are described in our Privacy Policy. By using the Service and creating an account you agree to that Privacy Policy. We also use cookies and similar technologies as explained in the Privacy Policy.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including if you breach these Terms. On termination, your right to use the Service will immediately cease. We may also delete the content associated with your account in accordance with our data retention policies.

9. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date. Continued use of the Service after changes means you accept the revised Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [insert city, e.g., Macerata].
